Terms and Conditions for European Seating Symposium incorporating Assistive Technology 2010 Registration

The agreement between the Assistive Technology & Specialised Seating Department and the Applicant shall incorporate and be bound by the following Terms and Conditions:

COMMUNICATION

The Applicant shall provide his or her physical address together with an electronic address at which the Assistive Technology & Specialised Seating Department may communicate with the Applicant for all purposes. The Applicant shall notify the Assistive Technology & Specialised Seating Department of any change in this address. In the absence of notification by the Applicant of a change in his or her electronic address, The Assistive Technology & Specialised Seating Department shall be entitled to communicate with the Applicant at the electronic address provided by him or her notwithstanding any apparent refusal or failure of communication. The Applicant shall be entitled to communicate with The Assistive Technology & Specialised Seating Department at its electronic or physical address and the Assistive Technology & Specialised Seating Department shall notify the Applicant promptly of any change in these addresses.

THE SYMPOSIUM

The Symposium refers to European Seating Symposium incorporating Assistive Technology hosted by Assistive Technology & Specialised Seating Department.

THE EXHIBITION

The Exhibition refers to the Exhibition at the European Seating Symposium incorporating Assistive Technology hosted by Assistive Technology & Specialised Seating Department.

REGISTRATION APPLICATION

The Applicant shall apply to enrol on the Symposium by completing the Application Form(s) provided.

PRICES AND PAYMENT

The Symposium Exhibition fee shall be as specified on the Assistive Technology & Specialised Seating Department website and/or Exhibitor Booking forms. The Exhibition fees are payable in full in advance. On acceptance of the Applicant's application and receipt of the Exhibition fee, Assistive Technology & Specialised Seating Department shall register the Applicant on the Exhibition.

The Symposium fee shall be as specified on the Assistive Technology & Specialised Seating Department website and includes payment for Symposium and its Pre-Symposium Courses. The Symposium and Pre-Symposium Courses fees are payable in full in advance. On acceptance of the Applicant's application and receipt of the Symposium fee, Assistive Technology & Specialised Seating Department shall register the Applicant on the Symposium and/or Pre-Symposium Courses. .

CANCELLATION

Exhibition Cancellation Policy

If the Applicant cancels his or her participation on the Exhibition on or before March 1st 2011, Assistive Technology & Specialised Seating Department shall be entitled to retain 50% of the Symposium fee for its administrative and other costs and the Applicant shall be entitled to a refund of 50% of the Exhibition fee paid by him or her.

If the Applicant cancels his or her participation on the Exhibition on or before June 1st 2011, Assistive Technology & Specialised Seating Department shall be entitled to retain 75% of the Symposium fee for its administrative and other costs and the Applicant shall be entitled to a refund of 25% of the Exhibition fee paid by him or her.

No refund will be offered for any Exhibition cancellation after June 1st 2011.

In the event of cancellation the Applicant shall not be permitted any or any further access to the Symposium material.

For the payments made electronically via registration form(s) hosted at www.seating.ie, the refunds will be made electronically using the credit/debit card details of the Applicant used for the Registration unless the Applicant does not accept so. In other cases, the refunds are made by cheque and/or bank draft.

Symposium Cancellation Policy

If the Applicant cancels his or her participation on the Symposium more than 90 days prior to its commencement, the Assistive Technology & Specialised Seating Department shall be entitled to retain 20% of the Symposium fee for its administrative and other costs and the Applicant shall be entitled to a refund of 80% of the Symposium fee paid by him or her.

If the Applicant cancels his or her participation on the Symposium between 60 and 90 days prior to its commencement, Assistive Technology & Specialised Seating Department shall be entitled to retain 30% of the Symposium fee for its administrative and other costs and the Applicant shall be entitled to a refund of 70% of the Symposium fee paid by him or her.

If the Applicant cancels his or her participation on the Symposium between 30 and 60 days prior to its commencement, the Assistive Technology & Specialised Seating Department shall be entitled to retain 40% of the Symposium fee for its administrative and other costs and the Applicant shall be entitled to a refund of 60% of the Symposium fee paid by him or her.

If the Applicant cancels within 30 days of the date for the commencement of the Symposium or after it has commenced he or she shall not be entitled to a refund. The Assistive Technology & Specialised Seating Department may cancel the Symposium at any time for any reason and in that event shall be liable only to repay to the Applicant the amount of the Symposium fee paid by him or her and The Assistive Technology & Specialised Seating Department shall not be liable for any loss or damage or consequential loss howsoever arising and suffered by the Applicant as a result of the said cancellation.

In the event of cancellation the Applicant shall not be permitted any or any further access to the Symposium material.

For the payments made electronically via registration form(s) hosted at www.seating.ie, the refunds will be made electronically using the credit/debit card details of the Applicant used for the Registration unless the Applicant does not accept so. In other cases, the refunds are made by cheque and/or bank draft.

 

COPYRIGHT AND INTELLECTUAL PROPERTY

The copyright in all Symposium material belongs to the Assistive Technology & Specialised Seating Department. The Applicant shall not cause or permit anything, which may damage or endanger the copyright or intellectual property of the Assistive Technology & Specialised Seating Department or the Assistive Technology & Specialised Seating Department title to it or assist or allow others to do so. The Applicant agrees to notify the Assistive Technology & Specialised Seating Department immediately of any misuse or infringement of The Assistive Technology & Specialised Seating Department's copyright or intellectual property of which the Applicant becomes aware.

GOVERNING LAW AND JURISDICTION

The agreement between the Assistive Technology & Specialised Seating Department and the Applicant shall be governed by the law of Republic of Ireland in every particular including formation and interpretation and shall be deemed to have been made in Republic of Ireland. Proceedings arising out of the agreement may be brought in any Irish Court of competent jurisdiction at Dublin, Republic of Ireland but the submission by the parties to such jurisdiction shall not limit the right of the Assistive Technology & Specialised Seating Department to commence any proceedings arising out of this agreement in any other jurisdiction that it may consider appropriate.

DATA PROTECTION

The Assistive Technology & Specialised Seating Department shall comply with the provisions of the Irish Data Protection Act 1988 in respect of personal information and data provided by the Applicant.
